La régulation foncière au Maroc

Le foncier agricole marocain est confronté à diverses contraintes : exiguïté des exploitations, morcellement excessif, extension de l'indivision et multiplicité des statuts fonciers dont la précarité ne garantit pas les conditions de sécurité et de stabilité. Cette situation semble se perpétuer malgré les efforts des pouvoirs publics qui ont accordé un intérêt particulier au foncier agricole notamment sur le plan législatif. Cependant, malgré cet important effort, les résultats sont restés très limités. En effet, les partages sur le terrain n'ont pas cessé, la privatisation des terres collectives en irrigué reste limitée, le secteur de la réforme agraire se heurte à des contraintes législatives ne favorisant pas les attributaires désirant entreprendre des investissements sur leurs lots et l'immatriculation est restée à des niveaux très faibles. Cette contribution s'intéresse, dans une première partie, à la régulation foncière selon les régimes traditionnel et moderne, puis, dans une seconde partie, à la régulation foncière selon les régimes juridiques des statuts fonciers. Il en ressort que pour dépasser ces limites, la mise en place d'une nouvelle politique foncière est impérative. Celle-ci devrait avoir comme objectif la sécurisation du droit de propriété, l'unification des régimes en statut melk, la levée des entraves à la mobilité foncière et enfin l'encouragement des groupements fonciers d'indivisaires.

Agricultural landholding in Morocco is exposed to several constraints: the small size of holdings, excessive land division, the increase in undivided ownership and a multiplicity of landholding statuses whose precariousness does not provide the conditions for security and stability. The situation seems to be continuing in spite of the efforts made by the public authorities who display particular interest in agricultural land and especially the legislative aspects. However, the results are limited in spite of this strong effort. Indeed, shared land ownership has not ceased, the privatisation of collective irrigated land is still limited, agrarian reform is coming up against legislative constraints that do not favour recipients who wish to invest in the land awarded to them and registration is still at a very low level. The first part of the article is devoted to traditional and modern forms of landholding while the second part covers landholding regulation according to the legal framework of land ownership statuses. It is seen that a new landholding policy is essential in order to go beyond these limits. The aims of the policy should be the assurance of secure property rights, the unification of positions in a melk status, the lifting of barriers to landholding mobility and finally the encouragement of the undivided land ownership groups.
